Research a digital forensic case where the search warrant was found to be inadequate or faulty. Describe the case and the outcome.

1. Based upon the Zubulake v USB Warburg decision, describe in details what is meant and involved by a “party’s duty to preserve”.  How can this be implemented and what should the consequences be for failure. 

2. A 26(F) conference outlined in the Federal Rules of Civil Procedure is considered to be an important first step in a litigation matter.  Why is it important and what should be discussed at the conference?  Discuss why digital experts should or should not attend. 

3. A case involves an individual that hacked in to federal government computer system from a Simpson College computer and stole sensitive information.  This information was stored on a Cloud based storage service.  The hacker then emailed a copy of the information using a Simpson College email system to the friend’s Gmail account.  What evidence you want to examine and what are all the legal means to get that information.

4. Describe in detail at least three exceptions to the search warrant rules and how they would apply to digital media.

Two groups will set up a mock crime scene in a selected room

Groups will then process the other groups scene.

Each student will develop and submit a CV suitable for courtroom purposes
